1. Agreement to terms

These terms and conditions form an agreement between you ("Client") and Pinaka Security ("we", "us", "our"). By engaging our services or using this website, you agree to these terms. If you do not agree, please do not use our services.

2. Services

We provide cybersecurity, managed IT, IT consulting, business systems, websites and digital marketing, and AI automation services as described on this website. The scope of each engagement is defined in a written agreement or statement of work, and we deliver services consistent with that scope.

3. Client responsibilities

The Client agrees to provide timely access to systems, information, and personnel reasonably required to deliver the services. The Client is responsible for maintaining the accuracy of the information and data they provide.

4. Fees and payment

Fees are set out in the agreement or proposal. Unless otherwise stated, invoices are payable within the terms stated on the invoice. We may pause services if an invoice remains unpaid beyond the agreed terms.

5. Intellectual property

Deliverables created specifically for the Client during an engagement become the Client's property upon full payment. We retain ownership of any pre-existing tools, frameworks, and methodologies used to deliver the services.

6. Confidentiality

Both parties agree to keep confidential information confidential and to use it only for the purpose of the engagement. This obligation survives the end of the engagement.

7. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or in connection with an engagement is limited to the fees paid for that engagement. We are not liable for indirect, incidental, or consequential damages, or for loss of profits, data, or goodwill.

8. Termination

Either party may terminate an engagement with written notice as specified in the agreement. Upon termination, the Client pays for services delivered up to the date of termination. Confidential information and data will be returned or destroyed as agreed.

9. Governing law

These terms are governed by the laws of the Republic of India. Disputes will be subject to the jurisdiction of the courts of India.

10. Changes to these terms

We may update these terms from time to time. Updated terms take effect when posted on this page. Continued use of our services after changes constitutes acceptance of the updated terms.

Refund Policy

1. Project work

If we cannot deliver a project milestone agreed in writing, you are entitled to a refund for the portion of fees relating to that unfulfilled milestone. We resolve scope and delivery questions promptly and in good faith.

2. Retainers and subscriptions

Ongoing services are billed in advance on a monthly basis. You may cancel at any time with notice as specified in your agreement. Fees for the current billing period are non-refundable, but unused future periods are not charged.

3. How to request a refund

Email [email protected] with your invoice details and the reason for the request. We respond within five business days and process approved refunds within ten business days.

4. No-refund situations

We do not refund fees for work already delivered, for client-caused delays, or where the Client changes scope after work has been completed.

Privacy Policy

1. What we collect

When you contact us, we collect the information you provide: your name, email address, phone number, and the contents of your message. We collect only what we need to respond to you and deliver our services.

2. How we use it

We use your information to respond to enquiries, provide services, send invoices and updates related to your engagement, and improve our services. We do not sell your personal information.

3. Sharing

We share your information only with service providers who help us operate (such as our email and form provider), and only to the extent needed to provide our services. We do not share your data with third parties for their marketing.

4. Data retention

We keep your information only as long as needed to provide services and meet legal obligations. You may request deletion of your personal data at any time by emailing [email protected].

5. Security

We use reasonable technical and organisational measures to protect your information. No method of transmission is completely secure, and we cannot guarantee absolute security.

6. Your rights
